These terms govern your use of Elemental Mandarin (the "Service"), an online Mandarin Chinese learning app with AI-powered features. The Service is provided by Elemental Lingua LTD, a company registered in the United Kingdom ("we", "us"). When you use the Service you are contracting with Elemental Lingua LTD.

1. Acceptance

By creating an account or continuing to use the Service, you agree to these terms. If you do not agree, please do not use the Service.

2. Eligibility and accounts

  • You must be old enough to form a binding contract in your country, or have a parent or guardian's permission.
  • If you use the Service for an organisation, you confirm you have authority to bind it.
  • Provide accurate information, keep your login details confidential, and you are responsible for activity under your account.

3. The Service and licence

The Service includes HSK lessons, flashcard decks, spaced-repetition review and AI tools (dictionary lookups, text scanning, deck generation, grammar and pronunciation feedback, audio). We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service within your chosen plan.

4. Acceptable use

You must not misuse the Service, including:

  • using it for anything unlawful, fraudulent, or to send spam;
  • infringing anyone's intellectual property or privacy rights;
  • uploading malware, probing or attacking our systems, scraping, or circumventing usage limits;
  • reverse engineering, reselling or redistributing the Service;
  • using the AI features to create illegal, hateful, harassing, sexually exploitative or deceptive content (including deepfakes), or attempting to bypass AI safety measures ("jailbreaking").

5. AI features

  • You are responsible for what you submit (text, images, audio) and must have the right to submit it.
  • AI output may be inaccurate or incomplete. Check important translations and explanations yourself; the Service is a learning aid, not professional translation, legal, medical or other regulated advice.
  • As between you and us, you keep rights in your inputs and may use outputs for your own learning, subject to these terms and applicable law.
  • We may filter, refuse or remove content and restrict accounts that breach these terms.
  • Rights-holders can report infringing content by contacting us; we will remove it where appropriate and may suspend repeat infringers.

6. Your content

You grant us a limited licence to host and process content you add (such as custom decks) solely to provide the Service to you.

7. Intellectual property

Elemental Lingua LTD owns the Service and all related intellectual property, including software, lesson content, documentation and branding. Nothing in these terms transfers ownership to you.

8. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, renewal, tax, cancellation and refund terms are set out in Paddle's Buyer Terms. Pro subscriptions renew automatically each month or year until cancelled; when you cancel, you keep Pro access until the end of the period you have paid for. See our Refund Policy.

9. Service availability

We work to keep the Service running well but do not guarantee it will be uninterrupted or error-free. We may change or discontinue features.

10. Suspension and termination

We may suspend or end your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You can stop using the Service and delete your account at any time. After termination we delete or anonymise your account data as described in our Privacy Notice.

11. Warranties and liability

  • To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose.
  • We are not liable for indirect or consequential loss, including loss of profits, data or goodwill.
  • Our total liability is limited to the fees you paid us in the 12 months before the claim.
  • Nothing limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law, or your statutory consumer rights.

12. Indemnity

If you are using the Service for business purposes, you agree to indemnify us against claims arising from your content, unlawful use, or breach of these terms.

13. General

  • Neither party is liable for delays caused by events beyond reasonable control.
  • You may not transfer your rights under these terms without our consent; we may transfer ours as part of a merger, acquisition or sale of assets.
  • These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere, you keep any mandatory protections of your local law.
  • We may update these terms; we will notify you of material changes.
